Privacy

Introduction
GFX International, Inc. (GFX) takes privacy seriously. It is our policy to comply with all applicable privacy and data protection laws. This commitment reflects the value placed on earning and keeping the trust of clients, business partners and others who share their information with GFX.

This Global Internet Privacy Policy (this “Policy”) describes how GFX protects the privacy of its Clients and Users (collectively referred to as “Clients” and “Users”) when collecting information on GFX Internet sites. As used in this Policy, the term “personal information” means information that identifies the User personally, alone or in combination with other information available.

This Policy applies, in general, to all Internet sites operated by or on behalf of GFX and its business units worldwide (each a “GFX Internet site”).

Web Site Privacy Statements
Although this Policy applies to all GFX Internet sites generally, each GFX Internet site has a different purpose and different features. If additional or different disclosures are required with respect to a specific GFX Internet site, disclosures on the site itself or in a separate web site privacy statement (“Web Site Privacy Statement”) will be posted on that site. Each individual disclosure or Web Site Privacy Statement supplements and amends this Policy, but only with respect to the GFX Internet site on which it is posted.

User Consent
By using a GFX Internet site or providing personal information, the User is consenting to the collection, use and disclosure of personal information as described in this Policy and any applicable Web Site Privacy Statements.

GFX reserves the right to change or modify this Policy. Such changes will be posted on the appropriate web site. Accessing the affected sites by a User constitutes consent to the use of the information gathered notwithstanding any conflicting or contrary provision in any existing or future confidentiality agreement, non-disclosure agreement or similar agreement or understanding that may exist, or come to exist, between GFX and the User.

If the User does not consent to the collection, use and disclosure of personal information as described in this Policy (and any applicable Web Site Privacy Statements), do not use GFX Internet sites.

Limitations: Collection, Use and Disclosure of Personal Information
To the extent required by applicable law, whenever GFX collects personal information on a GFX Internet site, GFX will:

Provide timely and appropriate notice to the User about its data practices
Collect, use, disclose and transfer personal information only with User consent, which may be express or implied, depending on the sensitivity of the personal information, legal requirements, and other factors
Collect personal information only for specific, limited purposes that will be relevant, adequate and not excessive for the purposes for which it is collected
Process personal information in a manner consistent with the purposes for which it was originally collected or to which the User has subsequently consented
Take commercially reasonable steps to ensure that personal information is reliable for its intended use, accurate, complete and, where necessary, kept up-to-date
Not use personal information for direct marketing purposes without giving the User an opportunity to “opt-out”
Take appropriate measures, by contract or otherwise, to provide adequate protection for personal information that is disclosed to a third party, including transfers within GFX

Collection and Use of Information
When the User accesses and uses a GFX Internet site, there are three ways information may be collected:

1. User Web Browser
GFX collects information that is sent automatically by the User’s web browser. This information typically includes the IP address of the User’s Internet service provider, the name of the User’s operating system (such as Macintosh® or Windows®) and the name and version of the User’s browser (such as Internet Explorer® or Netscape®). The information received is dependent upon the settings of the User’s web browser. Please check your browser to learn what information your browser sends and how to change your settings.
The information provided by the User’s browser does not identify the User personally. GFX uses this information to generate statistics to help improve its sites and make them more compatible with the technology used by its Internet visitors.
2. Cookies
GFX may obtain information about the User by installing a “tag” on the User’s computer’s hard drive. This tag is known as a cookie.
All GFX Internet sites use session cookies. A session cookie is used to tag the User’s computer with a computer-generated, unique identifier when the User’s accesses GFX Internet sites. A session cookie does not identify the User personally and expires after the browser is closed. Session cookies are used to collect statistical information about the ways visitors use sites, for instance, which pages they visit, which links they use and how long they stay on each page. This information, known as clickstream data, is analyzed in statistical form to better understand visitors’ interests and needs in order to improve the content and functionality of GFX Internet sites.
Some GFX Internet sites also use persistent cookies. Persistent cookies do not expire when a browser is closed; they stay on the User’s computer until they are deleted. By assigning the User’s computer a unique identifier, GFX is able to create a database of the User’s previous choices and preferences. In situations where these choices or preferences need to be collected again, they can be provided automatically, saving the User time and effort. For example, after the User makes a purchase, if the User decides to make another purchase, the shipping address will have been retained and will only need to be confirmed. If a GFX Internet site uses persistent cookies the User will be notified in the Privacy Statement posted on that site.
If a User does not wish to receive cookies, he or she may set the browser to reject cookies or to alert the User when a cookie is placed on the computer. Although the User is not required to accept cookies when visiting a GFX Internet site, the User may be unable to utilize all of the sites functions if the browser rejects cookies.
3. Knowingly and Voluntarily Provided
GFX collects the information the User knowingly and voluntarily provides when using a GFX Internet site. Examples of such information include the information a User provides when signing up to receive email alerts, when the User completes a GFX survey, when the User asks GFX a question or emails GFX with feedback. In many cases this information will be personal information.
GFX uses this information for the purposes for which the User provided it. For example, if the User provides his or her email address when signing up to receive email alerts, the User’s email address will be used to deliver the requested email alerts.
Information may also be collected on GFX Internet sites for various business purposes such as customer service, fraud prevention, market research, product improvements, service improvements and to provide the User and Client with information and offers believed to be of interest to the User. Personal information may also be removed to use the rest for historical, statistical or scientific purposes.
Many of the GFX Internet sites permit the User to make choices about the use of his or her personal information. In most cases, the User is asked to indicate his or her choices at the time and on the page where the User provides personal information.
